Overview
Dear colleague, dear colleague,

Estate administration is a particular kind of mandate. In addition to competence in administering estates, you also need to be able to locate all potential heirs – and this often requires skills and resources that are not always at your disposal.

We specialize in tracing heirs not only in Germany and the other German-speaking countries but also, and in particular, in Eastern Europe. Most of our staff are native speakers of Eastern European languages, enabling us to conduct quick and accurate research into ancestors or relatives of the deceased in many countries, especially in Russia and the post-Soviet states, the Baltic states, Poland, the Czech Republic, Hungary and Romania.

Whether local archives or online resources –  our team has many years of experience and expertise in the field of research as well as extensive legal knowledge when it comes to tracing heirs and estate administration. Our network of highly qualified colleagues includes lawyers, historians, genealogists and philologists, so even very complex issues can usually be solved quickly within our team, which often significantly reduces the total investigation time required.

We generally work on a success fee basis, meaning that we are only paid once we have successfully and completely concluded our investigations into the case. In exceptional cases, however, we are also willing to conduct investigations on a fee basis. Just get in touch – we are confident that we will be able to come to an agreement. Furthermore, you can decide how much assistance you would like to receive from us. By arrangement, we can just supply a single or multiple documents or, if required, carry out complete investigations.

If you trust us with your case, we make it a priority to keep you updated on the status of our investigations. Upon request we can, for example, send you regular progress reports by post or email.

Simply contact us for a free initial consultation. We are certain to come to a solution tailored exactly to your specific requirements.

Whether in the archive on site or on the Internet: Our team has years of experience and in-depth knowledge of research and extensive legal knowledge on the subject of heir identification and estate management. Our employees maintain good personal contacts with archives at home and abroad as well as with numerous German courts. In this way, problems can often be resolved quickly and the processing time can often be shortened.

So that you are always up to date, we will send you a report on the status of the investigation every three months. On request, we can also send you the report digitally (as a PDF and / or Word document) by email.

Upon successful completion of the investigation, you will receive a detailed report and a meaningful picture of the heirs. We will give you all the documents and evidence required for the certificate of inheritance procedure as well as a list with the contact details of the identified heirs. We would also be happy to prepare the certificate of inheritance application for you.

Eye level is important to us. Our service for you is geared towards ensuring that you, the curator of the estate, always remain in control of the proceedings and do not have to give up your case.

The earning potential of curators of the estate can often be expanded in cases with higher estate if, as curator of the estate, you also take on tasks for the heirs that are not part of the legal mandate of the classic curatorship, which generally ends after the heirs have been successfully identified. However, many communities of heirs would like you to take over the final settlement of the estate.

If you have any questions about the optimization of the fee to be agreed with the heirs and a corresponding authorization, we are happy to support you. Talk to us about this if necessary!

Costs
The processing of inheritance cases requires special skills, good legal knowledge, often foreign languages and knowledge of the archive situation and the possibilities of investigation.

In principle, a fee of € 95.00 per hour plus statutory fee is charged for processing by our office. VAT calculated. In addition, there are possible expenses for search fees and the costs of obtaining documents.

The hourly rate is uniform and includes correspondence, translations, on-site investigations, creation of heir pictures, analysis activities, evaluation of old handwritten documents, internet and database research, preparation of applications for certificates of inheritance, etc.

When it comes to costs, the focus is on transparency. With the settlement you will receive a detailed summary of expenses with receipts as well as an exact list of the time required.

After analyzing a case, you will receive a cost estimate and, if you wish, you can determine the total price up to which investigations can be carried out without further consultation. If the agreed budget is not sufficient, we will contact you in good time to discuss how to proceed. By arrangement, it is also possible that the case processing is carried out at our office's own economic risk.

In this case, the usual success fee rates determined by the case law will be charged, which, depending on the case, are between 10% and 33% of the estate.

If a contingency fee is agreed, there are no other costs. The success fee is agreed with the determined heirs and only arises if it is possible to prove the right of inheritance and to send the estate to the heirs.

For Probate Courts and Notaries

Overview
Dear Sirs,

The certificate of inheritance procedure and the procurement of the necessary documents, often also for the execution of wills and land register corrections, often play a decisive role in judicial and notarial practice.

It is not uncommon for the implementation of certificate of inheritance procedures, especially when the third or fourth order of succession is concerned, to present and implement complex chains of evidence. In particular, it becomes difficult or even impossible when investigations or the procurement of documents in Eastern Europe or overseas are necessary.

In addition to the necessary investigations and the procurement of documentary evidence or substitute evidence, precise procedural knowledge is required in the certificate of inheritance procedure.

Applicants are often overwhelmed by this and competent help is required that does not cover the tasks of probate courts and notaries. As a service provider, our office is happy to help applicants and to contribute to success in inheritance proceedings - even in confusing situations - and thus to relieve probate courts and notaries.

Experience since 1993 Dipl.-Verwaltungswirt (FH) Bernd Clasen

I have been working freelance for probate courts in Hamburg and the surrounding area for more than 20 years and have set up a self-employed estate curator.

I have been a member of the German Association for Inheritance Law and Asset Succession (DVEV) since 1998 and, together with lawyer Michael Doddek, I lead the estate maintenance work group in the DVEV.

In 2012 the Bund Deutscher Nachlasspfleger e.V. (BDN) was founded, of which I am a member. As a speaker and member of the Certification Committee of the NachlassAkademie, I am actively involved in the training and further education of estate curators and I am co-author of the manual "Nachlasspflegschaft" (zerb Verlag, 1st edition 2012).

In judicial and notarial practice, there is often a lack of time and it is also not the competence to advise applicants beyond the usual extent on how the documents required to establish the law of inheritance can be produced. Here applicants can be helped by our office and courts and notaries can be relieved.

In the case of direct commissioning of heir investigations by probate courts, the case processing is carried out at our office's own economic risk and the estate is not charged with costs.

In this case, the usual success fee rates determined by the case law will be charged, which, depending on the case, are between 10% and 33% of the estate. The success fee is agreed with the determined heirs and only arises if it is possible to prove the right of inheritance and to bring the estate to the heirs for distribution.

For Private Individuals
Services | Costs
Overview
As an individual, you will usually come into contact with us in one of the following two scenarios: either because we have identified and contacted you as a potential heir, or because you would like to ask us to help you in your own search.

If you have been contacted by us, this essentially means it is very likely that you stand to inherit from someone whom you may not have personally known. This is due in particular to German inheritance law, under which distant and very distant relatives are in some cases entitled to an inheritance, regardless of whether they are still or have ever been German citizens.

If you have received a letter from us, it is particularly important that you are aware of one thing: you have no need to worry about suffering financial loss as a result of this matter. If we have contacted you, it is far more likely that the opposite will be the case. Do not hesitate to get in touch with us and ask any questions you may have. We will take time to explain the situation to you and will subsequently be on hand to assist and advise you.

If you intend to contact us, this usually means that you would like our assistance with an inheritance case in your family. After a bereavement, grief is naturally at the forefront, followed by the numerous important things that suddenly have to be dealt with. When it subsequently comes to identifying the heirs of the deceased, and possibly proving one’s own right to the inheritance in court, people often find themselves left with a big question mark – what now?

Especially if the deceased had roots in today’s Eastern Central or Eastern Europe, if families were torn apart or if family members entitled to an inheritance have emigrated overseas, it may be difficult to obtain the necessary documents and proof. Events related to the two world wars often play a role – if, for example, a person involved died but his or her death was not officially certified.

International inheritance laws are often strict and complicated. In probate proceedings, succession must generally be fully proven and no allowance is made for the fact that you cannot always submit the documents required because they are very difficult, if not almost impossible, to obtain.

This is where we come in: we specialize in tracing heirs not only in Germany and the other German-speaking countries but also, and in particular, in Eastern Europe. Most of our staff are native speakers of Eastern European languages, enabling us to conduct quick and accurate research into ancestors or relatives of the deceased in many countries, especially in Russia and the post-Soviet states, the Baltic states, Poland, the Czech Republic, Hungary and Romania.

After the inheritance certificate has been issued by the probate court, the heir or the community of heirs is able to act. Upon request, a community of heirs can also entrust our office with the processing and distribution of the estate, as this preserves neutrality - which is often a major problem with communities of heirs.

In particular, if those involved in communities of heirs do not know each other personally or if those involved live abroad, commissioning our office can be of great advantage.

Often there are also tax issues or real estate as well as inheritance items have to be converted into money to be divided up. We can support you with words and deeds or take over these tasks entirely for you. For this we agree a price after consultation.
